What are the rules for paternity leave in California?

In 2004, California became the first state to offer paid paternity leave. It is possible to take up to six weeks leave at partial pay. Various circumstances are considered, and the employer can explain those to the expectant dad. Otherwise, FLMA provides for up to 12 weeks of unpaid leave for parents with a newborn or an adopted child.

Both you and your spouse are able to take paid family leave at the same time. You may only take paid family leave during the first year of the child's life. You require a medical certificate when you file your application for leave. There is a seven day waiting period before you can collect benefits.

Paternity leave is also a federal law as well. Depending on your employer, you should have put in a request for leave through your human resources department. Usually,you get the same amount of time as the mother, 3-6 months, paid leave.
