You must look up the forcible dtainer statute in your state and determine if your landlord has violated any of your procedural rights as a tenant. Then you must write a complaint, detailing this, and file it with the clerk of the local state court. It must then be served on your landlord by a process server.

If you are wrongfully evicted, then you should compile records of communications and agreements that have transpired between you and your landlord and then seek an attorney to file suit.

Get legal assistance a.s.a.p!!!! I'm not a lawyer, but have been in this type of situation. Have all your papers in order, and proof that you should not be evicted from you home...proof includes copies of rental receipts, money orders or check deposit copies. Stress to the judge at day of hearing of your landlord's negligence.

You have to prove that you were, in fact, wrongfully evicted. Gather some evidence to support your claim and then seek out a solicitor. They should be able to help you.
