Can you buy a gun with an OTH discharge?

I have an OTH discharge and I want to buy a gun for protection.

Felons are not allowed to purchase/possess firearms. You should be able to purchase a firearm, provided that you can meet the requirements of same in your state. An OTH shouldn't be an issue in the background check.

OTH should not bar you from owning a gun. Depending on your state, and federal laws, you are barred from owing a gun after conviction of various crimes, or DIShonorable discharge due to certain offenses. An OTH discharge should not interfere with your ability to purchase and own a gun.

As the OTH is less severe the the disqualifying Dishonorable Discharge, if you were convicted by courts martial you could still be prohibited (as a convicted felon), if the offense was punishable by more than 1 year incarceration- regardless of the actual sentence.

Department Of The Treasury, Bureau of Alcohol, Tobacco, and Firearms form 4473, Firearms Transaction Record, Part I Over-The-Counter sales, asks, in question 12g "Have you been discharged from the Armed Forces under dishonorable conditions? " The OTH is not a dishonorable discharge. By itself, it's conditions do not prevent Federally legal purchase of a firearm.

The only state that will not have your OTH discharge on record will be Texas. Those good old boys have successfully fought OTH legislation for years. You don't want to wait too long now that Bush is out of office. Take advantage of the present laws while you can. Just tell them you are a automatic weapons collector.
