What is the process for extraditing someone from one state to another?

Generally, all the states cooperate to return felons to the state where the warrant has been issued. There is a required process of forwarding the warrant to the state where the felon is being held to verify it. Then arrangements are made for the authorities to come retrieve the prisoner. Misdemeanor warrants are usually not pursued.

If you have a felony warrant in Ohio, say, and you live in Kansas, an Ohio officer can ask Kansas authorities to arrest you and then send someone from Ohio to transport you back to Ohio. There is no "extradition" between states as the is from one country to another. State cooperate to see that justice is served.

There is no state-to-state extradition. Extradition is from one country to another. Law enforcement in one state can notify another state of a warrant, have the fugitive picked up and held until they can retrieve that individual and return him to answer charges.

If you're picked up on the warrant, a hearing will be held to make sure you are the person they're looking for and that the warrant is valid. If that's the case, one locale will hand you over to the other.

You can generally only be extradited for felony charges. Therefore, you need not worry overly if the warrant is for a misdemeanor or infraction. As always, an attorney can advise.

If a valid arrest warrant and an executive order by the Governor have been issued, then a hearing takes place, if extradition is not waived, returned within 30 days.

If the law find out where you are now living they will notify the proper authorites who will escort you back to where the crime was committed.
