My husband and I are behind on some payments, can an out-of-state creditor garnish his checks and do we have any recourse if they try?

State law provides for garnishment so the request must come from within the state. An out-of-state creditor would likely assign the debt to an in-state collector and proceed accordingly.

If you both signed the agreement originally, then yes, the creditor can garnish his paycheck Try to contact them to see if they will accept a payment arrangement.

Although laws vary by state, an out of state creditor can generally garnish wages if they file a lawsuit in the state where your husband works, if you are in default on your loan.

Depending upon the state in which you live, the creditor may be able to sue you in order to get payment or garnish wages. Your state should have a district attorney's office on its official website and that entity can direct you to the proper person to talk to about your state's specific laws.
