Will a private pay nursing home have the right to take over my mom's Social Security payments?

I know that some nursing homes can take over your Social Security checks, but I thought that only applied to ones that are run by the state.

A nursing home does not "take over" social security payments without permission of the resident as part of the agreement for service. Private pay facilities must have assurances that the fees will be kept up to date and write these things into the contract.

This may be a "gray area". You really need to consult an attorney, there IS free legal advice for your Mom. The contract she signs with the nursing home may assign that right. You can find legal aid through your State's Attorney General's office. Sign nothing until you are sure.

Private nursing homes have the right too. There are parts of nursing home care that is not covered by insurance. All nursing homes have the right to take Social Security payments that are not covered by insurance since they are providing health care and basic needs for your mother.

If social security is your mother's only source of income then the private nursing home can take it to pay her way and giver her an allowance.
