How does inherited property that does not show all the names on the deed get handled?

If you inherit property than you should change the names on the courthouse records to avoid problems later. If you are selling the property in a hurry and the recording takes time, affidavits can be signed by anyone having claim to the property that they will transfer ownership. Best to get the records changed as soon as possible.

The deed will be updated to reflect the new owner(s) after going through probate. If the property is listed as owned by multiple heirs, the courts may mandate a sale so that everyone gets the monetary value instead of fractional ownership of a piece of property. One heir can get a loan and buy out the others.

You have to get an experience attorney to handle this one for you. A title search has to be done to see who has claim to the property. A jusge will decide who the rightful heirs are.

If the property goes through probate, the executor will arrange either the division of the property or its liquidation by sale so that the value of the property is divided among the heirs.

It goes through probate. The judge assigns ownership to all the heirs. The deed can then be updated to the new owners. The property can then be sold and the proceeds divided, or one heir can seek to buy out the ownership shares of the others. Owning property jointly is rarely wise.
