Can I get SSI if there is a judgment against me?

Determining your eligibility for SSI is based strictly on your need to receive the benefit. There is no credit check, no financial review, nothing like that. You will authorize the caseworker to review your medical records and solicit necessary information from your doctors. Judgments, liens, child support arrears, etc. are not part of the review.

Judgments have no affect on SSI. SSI cannot even be garnished, unless the debt owed is owed to the federal government. You have nothing to worry about; you can get SSI and your creditors cannot touch it.

To get SSI, you must be disabled, have lost your spouse and have dependent children, or be over 62. If this is the case, you qualify for social security income. This income is not only independent of whether or not there is a judgment against you, it cannot be garnished to collect a judgment.

If you qualify for SSI, a judgment against you should not affect this. However, if you owe the government they may be able to get a small percent.
