Can an employer keep my pay check if I steal from the company?

I stole from my company and now they are keeping my check.

The employer cannot keep your pay for any reason. If you are convicted in a court for stealing, you will arrange restitution. The employer CANNOT keep your check under any circumstances. Call the Labor Relations Board, and then call an attorney.

Your employer cannot accuse you of a crime. They cannot claim you stole or withhold pay for these claims. See an attorney if this is the case; you will win the suit. If you have been arrested, charged and convicted, THEN the employer can say you stole, but only then.

They can accuse him of anything ....that's how there gonna take him to court.....are they suppose to not accuse him and do nothing!!!!! Dumbest answer I have ever seen!!!!!  add a comment

They can certainly withhold any money owed to you that is not in excess of the amount you stole. Rather than worry about getting your money, worry whether or not they will prosecute the theft, and how this will affect your work history.

You have to research this with your local labor department, if it is illegal then you can take action about your former employee. Every juridiction is different and is hard to generalize in such matter.
