Very tricky to do. Depending on the state of residence, most records will take 5-10 years. In Michigan, it's ten to twenty years before any charge is expunged from the record. Most records are sealed by the court if you are under the age of 18. There's a good possibility this second charge will stay on your record indefinately.

A second misdemeanor for a marijuana charged can be expunged in most states. Each state differs on the requirements for expunging. In almost all cases if the charge happened under the age of 21 expunging is fairly certain. Contact your Attorney Generals office for the steps needed in your case.
