In California, if the termination is involuntary (firing), the employer must give a final paycheck at time of termination. If it is voluntary (quitting), the employer has seventy-two hours to hand-deliver or mail the check. The postmark date must be within three days (not the date the check is received).

An employer is required to issue your final paycheck per the schedule on which it issues all other paychecks. There are no provisions that allow an employer to withhold the final pay and no provisions that allow deductions from the final pay, other than what is agreed to in a signed contract. Contact the Labor Board.

If some one terminates you from a job they have 90 days to give you your last check in the state of California. But most employers will mail you your final check with in 30 days after you leave.
