Why is the new Yankee Stadium grandfathered?

The Yankees are in some peoples minds "sport gods" so they get plenty of privelleges that other baseball clubs do not have, so Yankee stadium is replicated after the old Yankee stadium, therefore they can grandfather it.

Rule 1.04, the MLB rule that requires post-1958 major league baseball fields to have specific dimensions, does apply to the 2009-era Yankee Stadium, but given the Yankees' and the old Stadium's extensive histories (and the fact that six other "new" stadia don't comply), it's not surprising that MLB hasn't objected.
