What should I know about getting custody while one parent is in rehab?

If one parent is in rehab, there is no question of who will get custody. When the other parent finishes rehab and maintains for awhile, s/he can petition for visitation or shared custody. A child has a right to both parents.

You will need to file an emergency custody order. Since the other parent is in rehab they can't provide care for your child. This will get you temporary custody.

You probably have a fairly good chance of getting custody since your child's other parent is in rehab. Usually when one of the parents does something that makes them unfit it's easier for the other parent to gain custody, unless they find that you're doing something that is dangerous to your child.

The other parent may be able to regain partial or full custody after getting out of rehab and proving sobriety or being drug-free. They may be able to demand visitation while in rehab.

You should know that a large number of people suffering from emotional disorders as adults suffer from a sense of abandonment be it real or perceived and as such when going for custody keep in mind that although the parent may be unfit he/she is still the parent and care must be taken when removing a child from a parent.
