What should I do if I mis-spoke at a deposition?

Notify your attorney. You might want to file an affidavit now stating you misspoke. The other option is to clarify at trial, but that can be harmful, especially in front of a jury. The main thing is to make a record about the mistake to avoid a perjury claim.

You must tell the attorney for your own side that you "misspoke", or if not available, inform the opposing attorney. You have spoken under oath, and it is imperative that you correct this. Be calm, just make the authority aware that you were mistaken. Not doing so is perjury.

If your deposition is taken, you will be supplied with a transcription of the questions and your answers. Usually each line on a page is numbered and there is a sheet where you list the line where you mis-spoke and put in the answer you intended to give.
