What is the mandatory sentencing for substantial assistance?

Substantial assistance's carry a different mandatory sentence based on the state. In general, the sentence will depend upon five factors reviewed by the court. There can be a plea, and a judge can decide on a lesser "safety valve" charge.The sentence can run from several months to 2-5 years.

Providing "substantial assistance," or being an accomplice, usually has the same sentence as the crime itself. Unless there's a mandatory sentence for the crime, there's usually a range of punishment.

Cooperation of the offender will be weighed and the substantial assistance provided will be considered in the sentencing. All defendants who cooperate at a given substantial assistance level receive a set and absolute number of months reduction in sentence or a relative amount at the judge's discretion (according to section 5K1.1 guideline). The Federal minimum sentencing guidelines also counts.
