What can I do if the management company hasn't returned my security deposit?

When this happens you have legal recourse in the courts. You are entitled to the return of your security deposit minus any rent due or damages. You also are entitled to interest on the security deposit and in some cases the company can be made to pay triple damages.

Check the contract and see what, if anything, they have promised to do regarding the deposit. Call the company to make sure an error has not been made. If they will not refund your money request an explanation, based upon this you may have grounds, and need, to sue.

The rules for this vary from state to state. The first step in any state, however, is to send a letter via certified mail, return reciept, demanding that they return your deposit. If this does not work, you will probably need to sue them.

In Ohio, if your landlord has not returned you security deposit to you within 60 days of you moving out, you have the legal right to take your landlord to court and ask for damages. Contact an attorney in your state to see what your rights are as a renter.
