What are the home disclosure laws in Illinois for septic problems?

Disclosure of plumbing issues is part of the disclosure form for Illinois. In areas where septic is used in place of public sewerage, inspections are applicable as a condition of the sales contract. There are time frames for the inspections, and you will need to check to see what they are. It is suggested that you use a buyer's realtor.

Generally real estate law prohibits the concealing of such problems. A home inspection will reveal problems as well. Attempts to deceive can void the contract to sell.

If you are the seller of a home and know that there is a problem with the septic system in your home you are required to disclose that information.

Caveat Emptor - let the buyer beware. Always get a licenced building inspector to examine your purchase, don't trust the seller. They don't "have" to tell you anything.
