Disclosure laws vary some from state to state. Basically, if you think you should disclose it than you should. You can check the specifics with a real estate attorney or with a realtor.

As part of the listing, you will sign a statement that says you have disclosed all information. Further, if you are asked specific questions by prospective buyers, you must answer honestly. An owner who fails to disclose information about a property is liable later. Talk to a real estate agent about specific laws in your state.

The seller must report foundation problems, known termite and insect infestations, safety hazards, and known needed repairs. Other required reporting varies by state.
