You should write a letter requesting assesment of your child and hand deliver this to your school principal or your district office. 2 weeks later you receive a "request to assess form" describing tests given. Sign and return document to school and they have 50 days to assess your child. Then schedule an appointment to discuss results and receive recommendations.

A child can only be "tested" for special education with written consent from the parent. In addition, depending on the individual school there may be more than one single test involved. Ask the school about your child's IEP and meet with someone from this department.

I found two laws on the Texas government site. They were: Individuals with Disabilities Education Act of 2004 Individuals with Disabilities Education Act of 1997 I am sure a quick Google search of special education rules and regulations in Texas will help you find more precise answers to your question.
