Is it illegal to write a bad letter of recommendation?

A letter of recommendation is a positive thing. If you cannot write a positive letter, politely decline the request. A "bad" reference is not a "recommendation."

Not that I know of it is not unless you are writing a letter that you know it does not true. That could be consider a form of fraud and a person could sue you in civil court over this. I would recomend looking into your local laws concerning,as every state is different.
