In California, what is the accepted retailer restitution for shoplifting groceries?

As the prosecuting party, the retailer would have to agree to a specific restitution for the theft. The defense would then work with the prosecution to come up with an agreement suitable for both sides.

If the value of the groceries taken is under $50.00, it is a misdemeanor or just an infraction. It would be up to the discretion of the prosecutor, depending on if you have already been charged with shoplifting already. The fine for a msdeameanor infraction is a nmaximum of $250.00.

California Penal Code allows for payment of no less than $50 and no more than $500, plus, costs, to the retailer; and for the cost of unrecoverable merchandise.

Most request that you pay back the amount that you stole. If it is your first charge you will most likly have to do some form of community service also. It also depends on which company you have stolen from,the amount of the goods, and if you have ever done this before.
