How do you removed a lien on a vehicle if the lienholder has gone out of business?

My niece bought a car and when she went to register it, she found out that theres a lien on it. The company that placed the lien is no longer in business. What should she do?

An owner cannot legally sell a vehicle that has a lien on it because the vehicle doesn't have "clear title." Tell your niece to contact the owner and demand a refund. If that doesn't work, file immediately in Small Claims in New Jersey.

In some states, this may be a very sticky problem. It is possible to get the Secretary of State to look up whether the corporation that owned the business has been taken over by another business or has indeed dissolved and to contact an officers to release the lien.

Find out who bought the lien from the lienholder. Your state's business licensing office should have contact information for the new business. Contact that business about the lien.

In most states, she would have to get a letter from the Secretary of State stating that the business is no longer in existence. But she still has to demonstrate that the business no longer is holding the lien, which may involve getting receipts or a statement from the previous owner.
