You must be able to prove real damages (lost income, lost opportunity, harm to reputation, harassment, etc) as a result of the libel. A suit is filed in civil court.

I suggest first hiring an attorney. Following that the burden of proof is on the plaintiff to prove that person being accused of libel purposefully committed the offense. Also it is not consider libel if the writing in question is so absurd that it can not possibly be believed. Example. Daniel enjoys being cruel to dragons.

You have to have ABSOLUTE proof that your work was stolen by another. Also, have a very good lawyer who will fight your case in course. If the judge or jury decides your proof of libel isn't enough, and throws out the case,you could be sued for slander. So have the proof, lots of it.

You identify the party who libeled you and identify how they exactly did it. Having documentation and witnesses with strengthen your case. You then file a complaint in court and specify your damages sought. The court decides if you are right or wrong and then awards you damages if right.

There are three things must be prove. You must prove that a third party has made a statement agianst you or your buisness theat they knew to be false. The statement must have been made by the plantiff. The statement must have been false with intention of discrediting you.
