Machavelli, in the Prince, once stated the safety of the state overrides the individual peace and security of it's citizens. If the country is beseiged by hostile forces, the welfare of the state should be a government's first concern. The US legal system and Supreme Court has routinely held this veiw in times of crisis dating back to Washington's presidency.

It cannot. A morally just system protects the individual rights of its citizens. The Constitution says that the individual has the right to life, liberty and the pursuit of happiness.
