Where you live while your divorce is pending is a matter between you and your soon-to-be-ex. The law does not require you to move, though most couples are usually separated by the time of the filing.

I dont think you "HAVE" to move right away, it just might be more comfortable to move before it's final. It would avoid unecessary stress and tension in the house.

If you are in the marital home, you will be advised by the judge when and if you must vacate the premises.

No, in actuallity there has been a trend emerging in this weak economy. Many couples choose to share the housemainly to due lack of finances. They have common areas of the house but have seperate sleeping arrangements. This can work out, provided the couple isn't in a violent environment.

I am not completly sure, but I believe that one of the two, the Judge will grant one or the other the housing which they share, whoever has custody if there are any children is the most likely one to retain the premises.

If you are still living with your spouse, as long as there is no physical conflict, you should not have to move.

If you have a legal separation agreement then you should not need to move. If you are disputing property, again a proper legal agreement should enable you to stay where you are.
