Yes, you can start a new business. You can even have a new business and current business running at the same time. However, if you or the business you are own is behind in its taxes, the IRS will come after you for the taxes owed. This is true regardless of whether the original business is open or not.

Since you probably owe back taxes, I would definitely not recommend trying to open one. Doing so will give the IRS all the more reason to do an audit on you. This can be a long, painful drawn out process. Pay the taxes you owe so that you can start with a clean slate.
