In most cases yes, just as long as your criminal background does not contain any felonies. Also be sure not to disclose anything that has been expunged or sealed

It depends on the cause for the RO. Best case scenario is that you can get a waiver, but that depends on your history with the legal system. The matter is sure to come up eventually so make sure your recruiter has all the details up front.
