Taxes. When the moonshiners started making moonshine during prohibition alcohol was illegal there was no system to collect taxes on it. When prohibition ended the moonshiners kept producing and did not pay taxes on it and still do not.

Moonshine is illegal because there is no way to regulate it. It is an extremely high degree of alcohol and there is no way to make sure that it is safe. Also it is made by indivisuals and sold illegally so the goverment isn't able to tax it at all.
