What should I know if I get a disability check and I owe child support?

Your ex does have the right to have some money deducted from your check. However, the amount that you will have to pay per month will probably go down.

Any money ordered by the legal system is money that will be collected by court order. So you disability check will be reduced by the child support. If you owe a lot they will take out a certain portion each check until you have satisfied the back payments that you owe.

If you owe child support and you are getting money from disability then you need to get your act in gear and pay the support. Since the state is currently paying the child support that you owe, they will attach any wages from disability to pay back the person you owe the money to.

Disability benefits are considered income, which is what is required to pay child support. Unless incarcerated or in a vegetative medical state, an individual is expected to contribute to the support of a child without fail. The court will determine your contribution and you must abide that order. Otherwise, the court will attach your assets and/or issue a warrant.

If you owe back child support then your disability check can be garnished to cover those expenses. Basically, if you owe support but cannot or will not pay the amount due any income you receive can and will be garnished to pay for your children. The only way to avoid this is to see the judge to amend the payments.

Depending on how much your check is and how much your child support is, they may be able to take child support from your disability check. This ability is also dependant on the type of disability.
