DPOA is a document that gives Power of Attorney to an individual on behalf of someone who is no longer capable of conducting his or her own affairs. Provided that the instrument has been properly prepared and executed, it is binding, affording the named individual the authority to conduct the affairs of named party.

DPOA persists even if the principal is incapacitated (due to illness or injury). It does not, however endure beyond the death of the principal.

The DPOA has standing until death or until the person revokes the power. The DPOA is better than the POA because it will last through someone being comatose; that is why it is preferred.

A Durable Power Of Attorney (that's specifically stated as such) continues in effect if/when the person granting it becomes incapable of making his/her own decisions. Whereas a Power of Attorney has a time limit or specific purpose, a DPOA gives the agent the authority to act on behalf of that individual. A Living Will is a type of DPOA.

Most important is that DPOA must be properly prepared and executed. Once done, a DPOA is a legal, binding document that allows the authority of conducting business and affairs of the named party (principal). DPOA continues until revoked by principal or in death of principal.

A "durable power of attorney" allows the named agent to act on behalf of the principal on any/all matters explicitly set forth in the POA. Matters in a D/POA may govern a myriad of financial/healthcare requests. If a POA is "durable", it will survive the incapacity of the principal; if it is not durable, then it loses effect at incapacity.
