Contact the Department of Labor and report them for not paying wages owed. If you have other coworkers with similar cases, it can be class action.

My first action would be to write a letter to the employer explaining your reguest. If that does not get it, the next step is to contact the national labor relations board. They will investigate and they will get you any payments owed to you. Employers do not like the board, they get results.
