What is the criminal statute of limitations in NY state?

For murder and other class A felonies, there is no statute of limitations. For other felonies, it's five years (except criminal disposition of solid waste, which is four years). For misdemeanors, it's two years.

It depends on the crime. Misdemeanors are usually three years. Felonies run to 7-10. Some crimes have no statute of limitations, for instance murder and first degree rape. Generally, the more harm that is done, the longer the statute in order to help resolve the case and bring justice to the victim.

The statute of limitations varies not only by the degree of an offense (misdemeanor/felony/etc. ) and division (civil/criminal), but also by the individual offense. Not all criminal felonies have the same statue, for example. Murder is the only crime without a statute of limitiations in any state, of course. Other than that, there is no short answer.

The criminal statute of limitations in the state of New York varies depending on the crime, some such as capital offenses and on going conspiracies are not subject to a time frame to be brought to justice.

For a Class A Felony, there is no statute of limitations. For any other felony it is 5 years, for a misdemeanor it is 2 years.
