What if my husband files for custody while he has the kids?

Once he files for custody, he will not be instantly awarded custody. He will have to show tat he is more fit to raise the children than you are and there will be a hearing to determine who is more fit. If he does file for custody, then consult an attorney.

The process will be the same whether you or your husband have the kids when he files. Ultimately, a family law judge will hear both parties arguments (and the state's if DCF becomes involved) and from that testimony determine which parent would best be able to provide for the child.
