Bats like to live in snug places that are high up. Chimneys fit this discription, as well as being easy to enter and exit. You shouldn't kill the bats for legal reasons, get a professional to remove bats. Then have tehm block off the chimney.

Most likely you will need to call an experiences exterminator in order to get them out of the chimney, if a fire doesn't do it.
