One of these requirements: minor has gotten married with parents' & court's permission; the minor has enlisted in the military with parental permission; a judge has issued a declaration of emancipation after the minor proves a list of required criteria, including parental permission, a job and legal source of income that is sufficient to support himself/herself.

To become emancipated in California you can get married or join the armed forces with parent permission. The other way is through a judge. You have to prove to a judge that you are 14 years old, living on your own, maintaining legal employment, financial responsible, and that being emancipated would be the best fit for the individual.

If one is unmarried and not in military service, one can become an emancipated minor in California after becoming 14 by a judicial declaration in the petitioner's county of residency. File forms MC-300 and MC-306; the judge will then determine whether you have parental consent to and a desire for emancipation and the legal means of supporting yourself via work.

In all most all area's there is age limit of at least 16 or even older such as only 17 years old can be emancipated. You of course have to make a case that it is best for your well-being and you will be most benefited by emancipation. You also have prove you live independently successfully.

A person wishing to be emancipated will need to go through the court system for the emancipation to be legally granted. The court will need justifiable reason to consider the emancipation and can grant or deny the request. If all parties concerned are agreeable than an attorney probably is not necessary.
