What are the New York state divorce laws on non-marital property?

When a husband and wife are separating and have no marital property as long as one is not covering the other on his/her life insurance and they don't have to sign a DRL ssection 177 form stating that they have a very simple and easy uncontested divorce and should not even have to appear in court.

If the couple was married in the state and at least one spouse has been a resident of the state for a continuous period of one year prior to filing.
