What are the laws regarding reinstating parental rights in Florida?

It is likely that a Family Court judge would review the case and examine the circumstances under which parental rights were relinquished. The parent would petition the court and ask to have rights re-instated. There are many factors to consider. It's not just a matter of looking up a statute.

The Court wants children to be able to have relationships with both parents and is loath to restrict parental involvement, much less deny it. To have rights reconsidered, the petitioner must be able to show that the reasons the rights were terminated no longer exist. If the parent voluntarily gave up the rights, reinstatement is more than likely not possible.

If your rights have been terminated in Florida AND YOU WERE NOTIFIED, then you will not be able to get your rights reinstated. If an inordinate amount of time has passed, or you did not register as a parent, you will probably not be able to overturn the judgment.

Generally, parental rights are revoked for specific circumstances. If those circumstances have been amended or improved, there can be consideration to reinstatement parental rights. Parental rights, custody and visitation are all very different matters to consider.
