Labor laws are primarily associated with the law regarding working conditions and discrimination in the workplace. Many states and the Federal government have minimum wage laws, often based on the cost-of-living for that state or area. Payment in excess of those standards are not against the law and subject to financial laws.

You will have to check with your state- to my knowledge only CA allows you to keep overpayments. If you have been overpayed- DON'T bank on it, check it out.

Labor law does not control accounting. If an employee is overpaid, he should report it to the employer. The employer can then make the necessary adjustments.

You have to pay back the money if you were paid it in accident. If you were promised a raise or bonus and then they state that it is an overpayment, you do not have to pay it back - but this requires proof of the promised wages or bonuses.
