The requirements are that the application for the nonimmigrant visa for the spouse AND the application for the visa be made in the country where the marriage took place. Once granted, Petition for Alien Relative, Form 1-130 and Petition for Alien Fiancé (e), Form I-129F must be filed.

A petitioner must prove an income of 125% of the government poverty line. For a family of two the dollar figure is $17,500. For each additional family member that figure goes up by an additional $4500.
