When a person takes a job they are required to designate who will get their pension in the event of their death. Make sure your wife has no other person who can get it like a ex husband or kids from another marraige. If your wife dies before you then most likely you will get it

You can get the benefits of her pension after she dies but if you're divorced from her, you don't have rights to her pension unless she's paying you child support.

If you are in a community property state, you likely have an automatic 50 percent right in a divorce situation. This carries against a will as well. Check your state.

You don't have the right to claim your wife's pension if she is still alive, but if she's already dead, you must have the documents to show that you are her legal husband and has the right to claim what is due for the living spouse. If claim's granted, then you have all the right to use your claimed money.
