Someone wrote me a bad check, what should I do?

Depending on the size of the check, you can take it to small claims court and have them file a court order for you to be paid.

This is actionable. It is "false utterance" which is a misdemeanor. Also, this can be fraud, theft by taking, etc. Report it to the police,it is not a civil matter.

Inform the person who gave you the check and ask when you can resubmit to the back for payment. Also inform them if you were give a charge from your bank and that you will expect that money back also. If they refuse to pay it go to the small claims court and file a complaint to get it back.

If they paid with a check for goods and services and the check was bad, then you can file charges for theft (they got something for nothing). If they wrote a bad check for debt repayment, you can sue for unpaid debt and seek collections. If the check was a gift and it was bad, you have no recourse.
