Employers have every right to do background checks on individuals they are hiring. This includes fingerprinting for the purposes of checking criminal backgrounds. Given the liability assumed by employers, it is an excellent practice.

Some jobs require fingerprinting. There is nothing to prevent an employer from asking potential applicants for fingerprinting. Those applicants who choose not to submit to fingerprinting will not be eligible for employment. Also, some professions require fingerprinting. Some examples are daycare workers, attorney's, police officers, corrections officers and some federal employees.

Yes it is. As long as they do not discriminate in who needs gets fingerprinted (by sex, age, race, religion, etc. ) it is perfectly legal. For some jobs in some states, those working with children, law enforcement, national security jobs and others it is legally required to be fingerprinted and have a background check.

Yes, depending on the nature of the job. A job dealing with children will want to know if you have ever been in trouble pertaining to children, hence the fingerprinting.
