It was invented in 1923 by Frank C. Mars (of the Mars Confectionery Company) and was patented in the US until 1925. It wasn't named for the galaxy, but for a famous milkshake of the time.

The Milky Way candy bar has been popular for many year. The receipt for the candy bar has changed over the years but today's Milky Way is still recognizable with its first introduction in the 1920s by Frank Mars.
