Early termination fees, should be agreed to and clearly stipulated in the initial contract for services. If there is no stipulated amount, and the parties can not reach an agreement, a judge must use his discretion to determine appropriate economic and punitive damages (if any).

Although there may be a general range of fee prices in the area, the termination fee should be clearly specified on the contract and that should be addressed before either party signs the contract. Some larger companies may have specific ranges, but the amount is really negotiable and should be agreed upon prior to the contract being signed.
