A person would have to prove that the doctor did not meet the applicable standard of care for the community or state that the person lives in. An expert may also be hired by the person or the person's attorney to review documentation and opine if it may be malpractice.

Malpractice is a matter of law. It involves some degree of thoughtlessness/intention/malice. A legal expert can advise you if the circumstances constitute malpractice.
