How do I know if I have a sexual harassment case?

Since sexual harassment violates federal law, the claim must be investigated by the EEOC. If you have been sexually harassed and have taken reasonable steps to resolve the problem but your employer has not responded, go to the EEOC, which will determine if you have action to file a case.

The only way to know is to discuss the specifics of what happened in detail with an attorney licensed to practice law in your home state. The rules for this can vary from state to state.

You probably want to talk to a lawyer before opening up to anyone else or filing a grievance. Get as much evidence as you can & talk to a lawyer to determine if you have a case.

In most jurisdictions this is very specifically defined. Your state has guidelines you can consult, call your Attorney General's office or consult legal aide. Federal guidelines also apply.
