How do I issue 1099-misc to an attorney?

I need tax advice.

You get a 3-part 1099 from from the IRS or a office supply house. The form is in color (red). You cannot print your own. Fill out the form (easy part). Mail one part to the attorney, then mail one part and a transmission form, to the IRS.

You can obtain 1099-misc forms from many office supply stores (they won't be available until closer to January) or request them from the IRS. You will need to fill out the attorney, address, their employer id number and amount you paid them. Follow instructions on what to mail.

If you paid an attorney for your personal legal service, you do not issue a 1099. A 1099 would be correct if you ran a law firm that retained an attorney on a nonemployee basis. Unless the attorney was performing the activity of your business, no 1099 is issued even though you deduct the legal fees as a business expense.

You can get the 1099 from the IRS by calling 1-800-TAX-FORM. Fill it out completely and send it to the attorney. File your copy with the IRS.
