How can i file a counter petition for custody?

If you do not have an attorney, can file a motion on your own at the Clerk's Office in the family court that heard or is hearing the case. Someone will help you file the motion to request a hearing in the matter. During the hearing then you will present hard facts to support your petition.

When a plaintiff in a divorce action files a petition for divorce, you must answer each and every allegation set forth in the suit. This would also be the time to counter-claim for custody.
