Does our system of justice put too much power in the hands of unelected officials?

The US justice system is sometimes criticized for allowing unelected officials, namely judges, to have too much power. Judges are appointed, and they can make new law with their rulings.

Justice does not rely on elected or appointed officials. Rather it is dependent upon the law as well as the rights afforded citizens by the Constitution. Each level of government has a system of checks and balances. The law also includes perimeters for punishments fines, penalties, sentences, etc.) that are observed by judicial authorities.
