Oak is very difficult to re-stain. You MUST sand it very well to get the top layers of the old stain off. Once you have a very uniform color to the stained area try your new stain in one small area of the wood. If you are happy with the look then finish it. If not than sand some more.

Sand the area, clean it off, buy some stain. Put on one coat with a brush, allow to dry ,re-coat.

Oak is not usually stained. The wood is darkened by treating with the vapors from spirits of ammonia(fuming). You have to strip off the existing finish and old wax polish with paint stripper. You make a tent of polythene sheet. Outdoors, put the cleaned piece inside, and a dish of ammonia. Leave for 24 hours or until suitably darkened.
